This form contains the information given to the buyer before a paid package is purchased through the institution panel on the UZEM platform (uzem.io). Buyer and buyer type
The buyer is the natural or legal person named in the billing details confirmed at checkout by the institution account placing the order.
- Individual buyer: For purchases made with individual billing details, the buyer is treated as possibly being a consumer; the relevant provisions of Consumer Protection Law No. 6502, the Distance Contracts Regulation and the Subscription Contracts Regulation apply.
- Business buyer: For purchases made with company or institution billing details for commercial or professional purposes, consumer legislation does not apply; the relationship is governed by the Turkish Code of Obligations and the Turkish Commercial Code. This form is given to business buyers for information.
Main characteristics of the service
- The service is the use of the online training platform (learning management system) with the learner capacity, storage and features of the chosen package for the chosen period.
- The service is provided electronically; there is no physical product or shipping.
- The capacity and features of the packages are shown on the pricing page and on the package screen in the institution panel.
- An up-to-date web browser and an internet connection are sufficient to use it.
Price and payment
- Package prices are list prices in US dollars. Payment is taken in Turkish lira; the exchange rate at the time of the order, the tax applied for the billing country and the total amount including taxes are shown at checkout per billing period (monthly or yearly) and fixed in the order. There are no additional delivery charges.
- With yearly payment, you pay 10 months' fee for 12 months of use.
- The accepted payment methods are those shown at checkout: debit/credit card (through a licensed payment institution) or bank transfer/EFT. Card details are not stored on the platform; they are processed by the payment institution.
- If no online payment method is offered at checkout, the order is recorded as a request without taking payment. In that case no charge is made and the package is not activated; payment details are sent to you separately. The request is valid for 7 days from the moment it is created; if payment is not collected and confirmed within that time, the request is cancelled automatically. This period is separate from the refund period for erroneous or duplicate charges.
- The invoice is issued according to your billing details after payment is collected and is sent to the e-mail address in your billing details.
- An unpaid order is cancelled automatically after a certain time (a few hours for card payments, a few days for bank transfer/EFT orders).
- Confirming the order means that you take on an obligation to pay.
Placing the order and forming the contract
- The contract is formed through these steps: (1) choosing the package and period, (2) entering billing details, (3) reviewing and confirming the order summary, this form and the contract texts, (4) creating the order and paying.
- Before the final confirmation you can go back to the earlier steps to check and correct your package, period and billing details. The amount is recalculated on the server; if it has changed, no order is created and the updated amount is shown to you.
- Once received, your order is shown in the institution panel with its order reference code. A copy of the texts you accepted is sent by e-mail; the versions in force are on the legal pages of this site. The content of the version you accepted is kept by the Company together with your order and is sent to you on request.
- The processing of personal data is subject to the KVKK Information Notice and the Privacy Policy.
Start and duration of the service
- The package starts once payment is collected and confirmed; it is not activated without payment. For card payments confirmation comes from the payment institution, for bank transfers after the payment has been checked.
- The period is one month or one year from the start date.
- An upgrade to a higher package applies immediately; the part of the amount paid in the current period that falls on the remaining time is deducted from the new package amount. Any part of this credit exceeding the new package amount is not refunded and is not carried over to the next period.
Renewal and ending
- Automatic renewal is optional. Only if the buyer gives explicit consent at checkout (or later in the institution panel), with separate checkboxes, both to storing the card with the payment institution and to automatic charges, is the card stored and the package renewed automatically at the end of the period for the same period length at that day's list price, exchange rate and tax. Details are in the Automatic Renewal and Card Storage Terms. The option is shown only while the platform offers it and only for a payment method that supports it; if it is not shown, the card is not stored and renewal is manual.
- Without this consent (also for card payments) the card is not stored and no automatic charge is made; the buyer pays the renewal manually at the end of the period. With bank transfer/EFT the buyer always pays the renewal.
- Automatic renewal can be turned off in the institution panel at any time. Turning automatic renewal off does not cancel the subscription: the package runs until the end of the period and the renewal is paid manually.
- Ending the subscription (leaving the package) is a separate action: before the period ends, a switch to the Free package or a lower package is scheduled in the institution panel; the change applies at the end of the period.
- Individual buyers' termination and refund rights under subscription legislation are explained in the Cancellation, Refund and Withdrawal Policy and are reserved.
- If a renewal payment cannot be collected, collection is retried a few times; after a short grace period the institution panel may become read-only. Data is not deleted; use continues once payment is made.
Right of withdrawal, cancellation and refunds
The right of withdrawal, cancellation and refund terms are explained by buyer type in the Cancellation, Refund and Withdrawal Policy. That policy is shown at checkout and is an annex to this form.
- Individual buyers: The withdrawal period is 14 days, starting, for service contracts, on the day the contract is formed. At checkout you confirm, with a separate checkbox that is not pre-ticked, that the service starts immediately upon payment confirmation before the withdrawal period ends; without this confirmation the paid package order cannot be completed. Under Article 15(1)(h) of the Distance Contracts Regulation, for a service whose performance started with your consent before the withdrawal period ended, the right of withdrawal cannot be exercised where the legislation allows this exception to apply; where the exception cannot be applied, your statutory right of withdrawal is reserved.
- Business buyers: The consumer right of withdrawal does not apply; the business terms are in the policy.
- For withdrawal notices and requests: [email protected] or Sururi Mah. Hoca Hanı Sok. No:19/82 Fatih / İstanbul. Please state your institution address and the order reference code.
Disputes
Consumers may apply, within the monetary limits set each year by the Ministry of Trade, to the consumer arbitration committee where they reside or where the transaction took place; for disputes above those limits, they may apply to the consumer court, subject to first applying to a mediator before filing a lawsuit under Article 73/A of Law No. 6502. For disputes with business buyers, the jurisdiction clause in the Distance Service Agreement applies.
Confirmation and records
When you confirm this form at checkout, the version, language and content you confirmed are recorded together with your order. A copy of the texts you confirmed is sent automatically after the order is created to the e-mail address in the billing details and to the e-mail address of the user who placed the order.
